Here we explain who processes your personal data when you use haztuhelado.com, for what purpose, on what legal basis, how long we keep it and how you can exercise your rights.

No Data Protection Officer has been appointed, as none of the circumstances set out in article 37 of the GDPR apply.

a) Contact form. We process your name, email address, telephone number (optional) and the content of your message in order to deal with and reply to your enquiry. Legal basis: your consent, given by ticking the box and submitting the form (art. 6.1.a GDPR).

b) Email. If you write to us directly, we process the data you include in your message in order to reply to you. Legal basis: your consent and, where applicable, the legitimate interest in dealing with the communication (art. 6.1.a and 6.1.f GDPR).

c) Cookies and browsing data. These are described in the Cookie policy. Analytics cookies are only activated if you accept them. Legal basis: your consent (art. 6.1.a GDPR and art. 22.2 LSSI-CE).

d) Newsletter subscription. If you subscribe to our newsletter, we process your email address in order to send you our articles and news. The subscription is confirmed by double opt-in (you will receive a verification email and we will not send you anything until you confirm it) and you can unsubscribe at any time from the link included in every message. Legal basis: your express consent (art. 6.1.a GDPR).

e) User account. If you register in order to use features such as «My recipes», we process your email address and your password (which is stored encrypted), together with the recipes and ingredients you save, in order to give you access to your personal area and to keep your work. Legal basis: your consent and the performance of the service requested (art. 6.1.a and 6.1.b GDPR).

f) Blog comments. If you post a comment, we process your name, your email address and the content of the comment, as well as your IP address to help detect spam, in order to manage and moderate the conversation. Legal basis: your consent (art. 6.1.a GDPR).

All the data requested is the minimum necessary. The fields marked as compulsory are essential in order to assist you; if you do not provide them, we will not be able to respond to your request.

Data from the form and from email communications is kept for as long as necessary to deal with your enquiry and, thereafter, for a maximum of one year in case you need continuity in the matter, unless you ask for it to be deleted sooner or it must be kept because of a legal obligation.

We do not sell or transfer your data to third parties. It is only accessed by the providers strictly necessary for the website to work, which act as data processors under a contract signed in accordance with article 28 of the GDPR:

• IONOS SE — web hosting and email. Servers located in Spain (European Union).
• Google Ireland Ltd. — usage statistics through Google Analytics, only if you accept analytics cookies.

Amazon Associates Programme. This website takes part in the Amazon EU Associates Programme in Spain. When you click one of our links to a recommended product, it is Amazon (Amazon Europe Core S.à r.l., Luxembourg) that records that visit through its own cookies in order to attribute the purchase and, in the markets where we are an associate, pay us a small commission, at no extra cost to you. That processing is governed by Amazon's privacy policy.

Data may also be disclosed to judges, courts and public authorities where there is a legal obligation.

Hosting is provided from servers located in the European Union, so it does not involve an international transfer.

Google Analytics may involve access to data from the United States by Google LLC. Such transfers are covered by the EU-US Data Privacy Framework (European Commission adequacy decision of 10 July 2023) and, in the alternative, by Standard Contractual Clauses. Remember that these cookies are only activated if you accept them.

You may exercise the following rights at any time and free of charge:

• Access: to know what data of yours we process.
• Rectification: to correct inaccurate or incomplete data.
• Erasure: to ask us to delete it when it is no longer necessary.
• Objection: to object to a particular processing operation.
• Restriction: to ask us to suspend processing in certain cases.
• Portability: to receive your data in a structured, commonly used format.
• To withdraw consent at any time, without affecting the lawfulness of the processing carried out beforehand.

To exercise them, write to info@haztuhelado.com stating the right you wish to exercise. We may ask you to prove your identity. We will reply within a maximum of one month.

If you consider that the processing of your data is not correct, or that we have not dealt properly with your request, you may lodge a complaint with the Spanish Data Protection Agency (C/ Jorge Juan 6, 28001 Madrid — www.aepd.es).

We apply appropriate technical and organisational measures to ensure a level of security appropriate to the risk, including encryption of communications by SSL certificate, access control to the information and regular backups.

This site is not aimed at children under 14 and we do not knowingly collect their data. If we detect that we have received data from a child under 14 without the consent of the holders of parental authority or guardianship, we will delete it.

By providing us with your data you warrant that it is true, accurate and up to date, and that it relates to you. If you provide us with third-party data, you undertake to have informed them beforehand of the content of this policy.

We may update this policy to adapt it to legislative changes or to new processing operations. The version in force will always be the one published on this page, with its date of last update.
